Terms of Service
Last updated: August 20, 2026
These Terms of Service (the “Terms”) are an agreement between ResultFlow, Inc. (“ResultFlow”, “we”, “us”), the Delaware corporation that operates Muster at mustercommerce.com,resultflow.ai, and resultflow.store, and the business that creates a ResultFlow account, joins the Muster waitlist, or installs a ResultFlow app (“you”, the “Merchant”). They govern your use of Muster, ResultFlow’s storefront personalization platform, dashboard, apps for commerce platforms (including BigCommerce), storefront scripts and widgets, and related services (together, the “Service”).
By creating an account, installing an app, or using the Service, you accept these Terms on behalf of your business and confirm you have authority to do so. The Service is offered to businesses, not consumers. If you have a separately signed agreement with ResultFlow, that agreement controls where it conflicts with these Terms.
1. The Service
ResultFlow personalizes your storefront: our software observes how shoppers use your store, selects page content per shopper in real time (for example headline, savings, delivery, reasons-to-buy, review, and recommendation widgets), optionally answers shopper questions through an on-store assistant grounded in your own published catalog and policies, and measures revenue impact against a held-back control group of your traffic. Measurement against a control group is inherent to how the Service works: a portion of your traffic sees your unmodified store so that lift can be proven.
2. Accounts and access
- Keep your credentials confidential. You are responsible for activity under your account, including by team members you invite. Multiple users of your store may use the app under their own platform logins.
- Provide accurate account information and keep it current.
- We may suspend access to protect the Service, your store, or shoppers (for example, on evidence of compromise or abuse) and will restore it once the issue is resolved.
3. Platform apps and authorization
When you install a ResultFlow app from a commerce platform’s marketplace:
- You authorize us to access your store through the permissions the platform presents at install (for our BigCommerce app, store content access and read-only order access) and to place our scripts and widgets on your storefront to provide the Service.
- Storefront scripts are registered under the platform’s consent categories, and shopper data collection is gated by your store’s consent configuration.
- Your use of the platform itself (e.g. BigCommerce) is governed by your agreement with that platform, not by these Terms; we are not responsible for the platform’s availability or conduct.
- Uninstalling the app removes our scripts and widgets from your store, revokes and purges our access tokens immediately, and triggers deletion of your store’s data as described in section 9 and our Privacy Policy.
4. Your responsibilities
- Storefront disclosures. You are the controller of your shoppers’ data. You are responsible for maintaining a lawful privacy notice on your store, obtaining any consents required in your jurisdictions (including cookie/tracking consent), and honoring shopper rights requests, which we will support as described in the Privacy Policy.
- Lawful use. Use the Service only for a lawful store and in compliance with applicable law, including consumer-protection, privacy, and advertising law.
- Accurate content. Content the Service generates or rearranges is derived from your catalog, policies, and reviews. You are responsible for the accuracy and legality of the source material and for reviewing merchandising claims where your industry requires it (e.g. regulated products).
- No prohibited data. Do not submit to the Service, or configure it to collect, data the Service is not designed to hold: shopper names, emails, phone numbers, postal addresses, payment card data, government identifiers, or health data. Our collection API is built to reject direct identifiers, and you agree not to attempt to circumvent that.
5. Acceptable use
You will not:
- reverse engineer, copy, resell, or provide the Service to third parties except as agreed;
- probe, disrupt, or overload the Service, or bypass its security or tenant isolation;
- use the Service to mislead shoppers, including fabricating scarcity, reviews, or prices;
- use the Service to build a competing product.
6. Fees
Pricing is as stated in the marketplace listing, order form, or other written agreement under which you obtained the Service, including any free evaluation, pilot, or performance-based arrangement described there. Fees are exclusive of taxes, which you are responsible for (excluding taxes on our income). Where a performance guarantee is offered, its specific conditions and measurement methodology are as stated in that written arrangement.
7. Your data
- As between the parties, you own your store’s data: catalog, orders, store knowledge, and the shopper data processed for you (“Merchant Data”).
- You grant us the rights needed to host, process, transmit, and display Merchant Data to provide the Service, consistent with our Privacy Policy.
- We process shopper data as your processor/service provider, on your instructions, with the safeguards, subprocessors, and retention schedule described in the Privacy Policy. A data-processing addendum incorporating Standard Contractual Clauses is available on request at privacy [at] mustercommerce [dot] com.
- We do not use Merchant Data to train machine-learning models and do not use one store’s data to benefit another. We may use aggregated, de-identified statistics that identify neither you nor any shopper to operate and improve the Service.
8. Intellectual property
We own the Service, including its software, models, decision engines, widgets, scripts, documentation, and all improvements. No rights are granted except the limited right to use the Service under these Terms during your subscription. Feedback you choose to give may be used without obligation.
9. Term and termination
- These Terms apply while you have an account or an installed app.
- You may stop using the Service at any time by uninstalling the app and closing your account.
- Either party may terminate for material breach uncured within 30 days of notice. We may terminate immediately for breach of sections 4 and 5.
- On uninstall or termination, our storefront scripts and widgets are removed, platform tokens are purged immediately, and your store’s data is deleted from our systems within 30 days (a prompt reinstall cancels the pending deletion). Sections 7 through 13 survive termination.
10. Disclaimers
Except as expressly stated in a written agreement with you, the Service is provided “as is” and “as available”, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Personalization outcomes depend on your traffic, catalog, and market: except where a written performance arrangement states otherwise, we do not warrant any particular revenue result. We are not responsible for the commerce platform, your store’s other apps or theme, or connected third-party services.
11. Limitation of liability
To the maximum extent permitted by law: neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data; and each party’s total liability under these Terms is capped at the amounts you paid us for the Service in the 12 months before the claim (or US $100 if you have paid nothing). These limits do not apply to your payment obligations, either party’s indemnification obligations, or liability that cannot be limited by law.
12. Indemnification
You will defend and indemnify ResultFlow against third-party claims arising from your store, your products, your storefront disclosures and consent practices, or your breach of these Terms. We will defend and indemnify you against third-party claims that the Service, as provided by us and used as permitted, infringes their intellectual-property rights.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules, and the parties submit to the exclusive jurisdiction of the state and federal courts located in Delaware. Each party waives any right to a jury trial. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
14. General
- Changes. We may update these Terms; material changes will be notified by email or in the dashboard at least 14 days before taking effect. Continued use after the effective date is acceptance.
- Assignment. Neither party may assign these Terms without consent, except to a successor in a merger or sale of substantially all assets.
- Entire agreement. These Terms, the Privacy Policy, and any written order form are the entire agreement and supersede prior discussions. If any provision is unenforceable, the rest remains in effect. Failure to enforce is not a waiver.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
